I run a small business from home. What do I need for GST registration?

Where the premises are not owned or rented in your own name, the owner has to give written consent to the address being used as your principal place of business, together with proof of their ownership. Many officers accept a plain signed consent with the ownership proof; many want it notarised. We prepare it so it is accepted either way.

Is a commercial rent agreement different from a residential one?

Yes, materially — in stamp treatment and in content. A shop, office or godown agreement needs permitted-use limits, the GST position on rent, lock-in reflecting the tenant's investment, fit-out and reinstatement terms, and what happens on a sale of the business. Using a residential template for commercial premises is a false economy.

Two of us have been running a business together without any agreement. Should we make one?

Yes, and register the firm with the Registrar of Firms, Gujarat. Registration is optional in law, but an unregistered firm cannot sue to enforce a contractual right against a third party, and a partner cannot sue the firm or a co-partner to enforce the deed. Section 69(3) preserves suits for dissolution and for accounts of a dissolved firm, but firms discover the rest of it when they try to recover money.
