What an affidavit does — and what it does not do
Notarisation certifies that the deponent appeared before the Notary and swore to the contents. It does not certify that the contents are true. That distinction matters, because people are sometimes sold an affidavit as though it were proof of a fact. It is proof that you said the fact, on oath, and made yourself liable if you lied.
Indian evidence law does attach a presumption to one notarial act in particular: section 84 of the Bharatiya Sakshya Adhiniyam, 2023 directs the court to presume that a power of attorney executed before and authenticated by a Notary Public was so executed and authenticated. Note carefully what that covers — due execution and authentication, not the truth of the contents — and that it is rebuttable. No equivalent presumption attaches to a notarised affidavit, and courts have repeatedly held that notarisation of an ordinary affidavit or agreement raises no presumption that what it says is correct.
What every affidavit needs
- Stamp duty under the Gujarat Stamp Act, 1958. The Act was amended in 2025, so a rate you were told two years ago may no longer be right. We confirm the current value before you pay.
- Correct drafting. Most affidavits that get rejected are rejected on the wording, not the stamp — a fact stated too vaguely, a document not identified by number, a deponent who has no personal knowledge of what he is swearing to.
- The deponent, in person. The oath is administered to a person, not to a piece of paper. Whoever swears the affidavit must appear before the Notary — at our office, or we attend at yours.
- Signature and official seal. Under section 8(2) of the Notaries Act, 1952, nothing is a notarial act unless it is done under the Notary's signature and official seal. A signature alone is not notarisation.

Since the Ministry of External Affairs simplified passport documentation, most passport annexures are plain-paper self-declarations that need no stamp paper and no notary — Annexure F, for a lost or damaged passport, is the main one that still normally requires a sworn affidavit. Anti-ragging undertakings moved online to antiragging.in. EPFO corrections are now usually an online joint declaration by member and employer. We would rather tell you that than sell you a notarisation you do not need.
Affidavits people ask us for most in Vadodara
The heaviest volume is name and identity work — a name spelled one way on the school leaving certificate, another on Aadhaar, a third on the PAN card. The one and the same person affidavit is the fix where nothing is being changed and both versions simply need to be identified as you.
