A marriage is dissolved only by a decree of a Family Court. Papers signed on stamp paper before a notary do not end a marriage, whatever the person selling them calls it. We do prepare the full document set for a mutual consent petition under section 13B of the Hindu Marriage Act, 1955 or section 28 of the Special Marriage Act, 1954 — the joint petition, the consent terms covering alimony, custody and property, the affidavits of both parties, and the second-motion papers after the statutory cooling-off period. The decree comes from the court.
Adoption — register it
Section 16 of the Hindu Adoptions and Maintenance Act, 1956 provides that where a document registered under any law and signed by both the person giving and the person taking the child in adoption is produced, the court shall presume the adoption was made in compliance with the Act — unless and until it is disproved. That is a rebuttable presumption, and it is real: an unregistered deed gets no such help. But be clear that registration does not cure a defective adoption. The actual giving and taking of the child under section 11 remains essential; a registered deed without it does not make an adoption good.
But a deed is not always the right route at all. Adoption of an orphaned, abandoned or surrendered child, and any inter-country adoption, must go through CARA and the court under the Juvenile Justice Act, 2015. A deed alone will not do it, and proceeding on one causes serious problems later.
Guardianship
A guardianship deed records an arrangement. It does not create legal guardianship. Where a legal guardian is needed — as distinct from a natural guardian — the route is an application to the District Court under the Guardians and Wards Act, 1890. HUF deed
A declaration of Hindu Undivided Family records the creation and composition of the HUF, its Karta and coparceners, and is what you need to obtain an HUF PAN and open the HUF bank account. On partition, note that income-tax recognition of a partial partition of an HUF has long been restricted — under section 171(9) of the Income-tax Act, 1961, partial partitions after 31 December 1978 are not recognised, the family continues to be assessed as undivided, and members are jointly and severally liable. The Income-tax Act, 2025 has since replaced the 1961 Act, and the corresponding provision should be checked in its current form before any HUF partition is drafted. Worth advice before drafting, not after.
Maintenance and senior citizens
Parties cannot contract out of statutory maintenance rights; a court can still order more than the agreement provides.
Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is more powerful than most families realise, and narrower than most websites suggest. Where a senior citizen transfers property subject to a condition that the transferee provide the basic amenities and basic physical needs of the transferor, and the transferee then refuses or fails to do so, the transfer is deemed to have been made by fraud, coercion or undue influence and may be declared void by the Maintenance Tribunal at the transferor's option. The Supreme Court held in Sudesh Chhikara v. Ramti Devi (2022) that both conditions must be established; a later decision has taken a more purposive view, so the question whether the condition can be implied is still developing. The practical lesson for a family transferring property to children on an understanding of care: write the condition into the deed.
