Filling in the blanks is the easy half. It still has to be executed on stamp paper of the value currently prescribed, signed by the right people in the right order, and — depending on the document — sworn before a Notary or registered with the Sub-Registrar. A correctly worded document on the wrong stamp, or signed by the wrong person, fails just as completely as a badly worded one.
Bring it in and we will check it, e-stamp it and notarise it in the same visit. If it is wrong for what you actually need, we will tell you before you pay for anything.
What you are actually signing
An indemnity bond is a promise to make good the other party's loss if what you told them turns out to be wrong, or if someone else later turns up with a better claim. It is not a formality. If the bank releases a deceased account holder's balance to you on an indemnity bond and another heir sues successfully, the bond is what the bank relies on to recover from you personally.
Read who the indemnity runs to and how far it goes before signing. A bond that indemnifies against "any and all claims whatsoever" is wider than one limited to the specific transaction, and there is usually no reason to give the wider one.
Where a bank or an authority accepts an indemnity bond in place of a succession certificate, it protects the bank, not you. The other heirs' rights are untouched, and they can still claim against you. Where the amount is significant or the family position is not settled, the succession certificate is the safer route even though it is slower. A legal heir certificate is not conclusive for a large bank claim.
An indemnity bond is executed on stamp paper of the value prescribed by the Gujarat Stamp Act, 1958. We confirm the duty for your specific bond and issue the e-stamp against it.
What to bring when you come in
- Aadhaar and PAN of the person giving the indemnity
- The authority's written requirement — most prescribe their own wording
- Any related affidavit or application already filed
- Two witnesses with photo identity — bring your own
